The terms that apply when you use the Hawfinch platform. Operated by Boring Software Ltd, governed by the laws of England and Wales.

By accessing or using the Hawfinch platform (the Platform), you agree to be bound by these terms of service (the Terms). Hawfinch is operated by Boring Software Ltd, a company registered in England and Wales (company number 16328193) with its registered office at 128 City Road, London, EC1V 2NX.
If you are entering into these Terms on behalf of a company or other legal entity, you confirm that you have the authority to bind that entity. If you do not have such authority, or if you do not agree with these Terms, you must not use the Platform.
2. The service
Hawfinch is a lead management platform built for high-volume lead generation businesses. The Platform provides lead ingestion via API and file upload, phone validation including HLR lookups, buyer routing through configurable waterfall logic, campaign management with caps and scheduling, and reporting dashboards with full analytics.
The Platform runs on shared, managed infrastructure. Each customer's lead data, campaign configuration, and reporting are logically separated, so no other customer can access them. Dedicated infrastructure is available on Enterprise plans. Access is provided on a subscription basis as set out in your signed service contract.
3. Account and access
New accounts start with a three-month free trial. You can sign up yourself or ask us to set up your account with you during onboarding.
You are responsible for safeguarding your account credentials and API keys. You must notify us without delay if you become aware of any unauthorised access to your account or suspect that your credentials have been compromised.
4. Acceptable use
You agree to use the Platform only for lawful lead generation and management activities.
4.1 Compliance with law
You must comply with all applicable data protection legislation (including the UK GDPR and the Data Protection Act 2018), the Privacy and Electronic Communications Regulations (PECR), and any equivalent laws in the jurisdictions where you operate.
4.2 Platform integrity
You must not attempt to circumvent rate limits, buyer caps, or routing rules configured within the Platform, and you must not use the API in a way that interferes with the stability of your own or any other customer's environment.
5. Your data
All lead data, campaign configurations, and analytics you create within Hawfinch remain your property. Your data is logically separated from every other customer's data and is only accessible to your account, unless you have agreed to dedicated infrastructure on an Enterprise plan.
We process personal data in accordance with our privacy policy, the UK GDPR, and the Data Protection Act 2018. Where required, we will enter into a Data Processing Agreement with you. Lead data processed through the Platform (including contact details, validation results, and routing outcomes) is stored in data centres in London, United Kingdom.
6. Fees and billing
Subscription fees are as published on our pricing page, or as set out in your contract for Enterprise plans. Plans are billed monthly, or yearly at 15% off. Subscription fees are charged in advance of each billing period; leads over your plan’s allowance and HLR lookups are billed in arrears at the end of each month. All fees are payable in pounds sterling unless agreed otherwise.
All fees are exclusive of VAT and any other applicable taxes, which will be added to invoices at the prevailing rate. Late payment may result in suspension of access in accordance with the notice provisions of your contract.
7. Availability
We aim to keep the Platform available at all times but do not guarantee uninterrupted service. Uptime commitments and any service credits apply only where set out in a signed Enterprise agreement. Planned maintenance will be notified in advance where practicable.
8. Limitation of liability
To the maximum extent permitted by applicable law, Boring Software Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of leads, lost revenue from buyer routing failures, or corruption of campaign data.
Our total aggregate liability in respect of all claims arising under or in connection with these Terms shall not exceed the fees you paid to Hawfinch in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
9. Termination and data export
Either party may terminate the service agreement in accordance with the notice period and conditions set out in your signed contract.
Upon termination or expiry, we will keep your account data available for thirty (30) days so that you can export your lead data, campaign history, and reporting records via the API or CSV download. After this export window closes, all of your account data (including backups) will be securely destroyed within sixty (60) days. We will provide written confirmation of deletion on request.
10. Changes to these terms
We may revise these Terms from time to time. Where we make material changes, we will notify the primary account contact by email at least thirty (30) days before the revised Terms take effect, and we will post a summary of changes within the Platform dashboard.
Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree with any revision, you may terminate your account in accordance with section 9.
11. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales. Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
